Is Delta 8 Legal in Nevada?

Delta 8 THC is a cannabinoid derived from hemp that has psychoactive effects similar to Delta 9 THC, the main compound in marijuana. However, Delta 8 THC is less potent and may have some therapeutic benefits.

Delta 8 THC products have become popular in recent years, especially in states where marijuana is illegal. But what about Nevada, a state that has legalized both medical and recreational marijuana?

Is Delta 8 THC legal in Nevada? The answer is no.

Delta 8 THC is not legal in Nevada, and it is classified as a controlled substance under state law. The use, possession, sale, purchase, distribution, production, or manufacturing of Delta 8 THC products is prohibited by law in the state.

Can You Consume Delta 8 THC in Nevada?

Nevada has been a state known to have easy cannabis laws, but unfortunately for Delta 8 THC lovers, Nevada state law banned this cannabinoid in 2021. Nevada’s stance on Delta 8 THC may seem surprising since this is a state that legalizes both medicinal and recreational cannabis for adult use.

However, when Nevada lawmakers updated the definition of hemp, they closed the loophole that made Delta 8 THC legal and specifically listed the compound in their Controlled Substances Act.

According to the current Nevada hemp law, hemp is defined as:

Hemp’ means plant species Cannabis sativa L. and any part of such a plant, including, without limitation, the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a THC concentration that does not exceed the maximum THC concentration established by federal law for hemp. The term does not include synthetic cannabinoids, including, without limitation, delta-8 THC, delta-9 THC, delta-10 THC, and THCA.

This means that delta 8 THC and all other isomers of THC are considered synthetic cannabinoids and are not included in the legal definition of hemp. Therefore, delta 8 THC products are not legal hemp products in Nevada, and are subject to the same penalties as marijuana products.

Can You Travel to Nevada With Delta 8 THC?

Since Delta 8 THC is illegal in Nevada, it is not advisable to travel to Nevada with Delta 8 THC products. Doing so may result in legal trouble, especially if you are crossing state lines or flying with Delta 8 THC products.

Even if you are coming from a state where Delta 8 THC is federally legal, you are still subject to the laws of the destination state. Therefore, you should not bring Delta 8 THC products to Nevada, or any other state where Delta 8 THC is illegal.

Can You Drive Under the Influence of Delta 8 THC in Nevada?

Driving under the influence of Delta 8 THC in Nevada is also illegal and dangerous. Delta 8 THC can impair your judgment, reaction time, coordination, and motor skills, which can increase the risk of accidents and injuries.

Nevada has a zero-tolerance policy for driving under the influence of any controlled substance, including Delta 8 THC5. This means that if you have any detectable amount of Delta 8 THC in your blood or urine, you can be arrested and charged with a DUI.

What Are the Age Restrictions for Using Delta 8 THC in Nevada?

Since Delta 8 THC is illegal in Nevada, there are no age restrictions for using Delta 8 THC in the state. However, even if Delta 8 THC was legal in Nevada, it would likely have the same age restrictions as marijuana products, which are only legal for adults 21 years of age or older.
