Is Delta 8 Legal in Montana?

Delta 8 is a cannabinoid derived from hemp that has psychoactive effects similar to Delta 9 THC, the main compound in marijuana. However, unlike Delta 9 THC, Delta 8 is legal at the federal level under the 2018 Farm Bill, which legalized hemp and its derivatives as long as they contain no more than 0.3% of Delta 9 THC.

This has created a loophole for Delta 8 products to be sold and consumed in many states where marijuana is illegal.

But what about Montana? Is Delta 8 legal in Montana, and if so, where can you buy it?

Can You Consume Delta 8 in Montana?

The answer is no. Montana, known for its stunning landscapes and outdoor recreational opportunities, has specific laws regarding the legality of Delta 8 products.

According to the Montana state code, all tetrahydrocannabinol - including isomers such as Delta 8 THC - are illegal. The word “tetrahydrocannabinol” (plural) is important here - this means the law covers all forms of THC, not just the Delta 9 THC isomer. Therefore, Delta 8 THC is considered a Schedule I substance in Montana, along with marijuana and other drugs with high potential for abuse and no accepted medical use.

This law completely contradicts the federal law that recognizes Delta 8 THC as legal, as long as it is derived from hemp and contains less than 0.3% of Delta 9 THC. However, state laws can override federal laws when it comes to controlled substances, and Montana has chosen to do so. This means that anyone who possesses, sells, or consumes Delta 8 THC in Montana could face criminal charges and penalties.

Can You Travel to Montana With Delta 8?

It is not advisable to travel to Montana with Delta 8 products, as you could risk getting arrested and prosecuted for violating the state’s drug laws. Even if you are coming from a state where Delta 8 is legal, such as Colorado or Oregon, you could still face legal troubles if you cross the border with Delta 8 in your possession.

Montana does not recognize the legality of Delta 8 THC from other states, and does not have any reciprocity agreements with other states regarding hemp or marijuana products.

Can You Drive Under the Influence of Delta 8 in Montana?

Driving under the influence of Delta 8 THC in Montana is a serious offense that could result in fines, jail time, and license suspension. Montana has a zero-tolerance policy for driving under the influence of any controlled substance, including Delta 8 THC. This means that if you are caught driving with any amount of Delta 8 THC in your system, you could be charged with DUI, regardless of whether you are impaired or not.

What Are the Age Restrictions for Using Delta 8 in Montana?

Since Delta 8 THC is illegal in Montana, there are no age restrictions for using it, as it is prohibited for anyone of any age.
