Because delta 8 and CBN both contain less than 0.3% of delta 9, it is legal to produce, distribute, and sell in the United States. 

However, each state makes its own rules and regulations in regards to hemp products, and multiple states have restricted or banned the use of cannabinoids like delta-8 and CBN. As long as you live in a state that has not outlawed delta-8 or CBN, it is legal for you to purchase it.
