The Farm Bill finally distinguished between hemp and marijuana, meaning that low-THC derivatives of cannabis are no longer considered a Schedule I substance and are therefore no longer controlled by the DEA. 

The 2018 Farm Bill was intended to help consumers access legally produced and federally regulated hemp-derived cannabinoids like CBD, CBN, and others. Delta 8 became legal in a loophole with the passing of this bill which was enacted so that the FDA could finally regulate natural cannabinoid products like CBD. Although the Farm Bill explicitly stated that it did not include delta 9, it did inadvertently legalize delta 8.
